Is there anything more contentious than the debate over intellectual property (IP) protection? The “Napsterization” of just about everything digital has one side jumping with joy, and the other claiming the end times are near. Is there any common ground? We’d like to suggest there is, but first everyone must realize that there are no clean-cut, easy answers in this debate.
Defining and bounding intellectual property rights is complicated. The field is subdivided into four major domains: Copyright governs written, visual, and audio creations; patents apply to inventions; trademarks deal with brand protection; and trade secrets cover confidential information.
An argument may even be made by the two paragraphs above: 1) as quoted by the Reason Foundation and 2) as quoted by the Cato Institute. Are these excerpts a product of intellectual property? Or did we just establish the right to copy and paste the language from their website? We’ll let you decide an answer for this example.
